Terms of Use

These Terms of Use (“Terms”) constitute a legal agreement between you and Donovan Harshbarger, d/b/a InquiSoft (“Site Owner”). By using this web site (“the Site”), you agree to be bound by these terms.

The Site Owner may revise these Terms at any time by updating this posting. By continuing to use the Site after such changes,you agree to be bound by those changes. You should visit this page periodically to review the Terms for changes.

Provided that you comply with the Terms, the Site Owner grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site.

Intellectual Property

The Site, including its design, content, code, features, functionality, and all related intellectual property rights, is owned by Donovan Harshbarger and is protected by copyright law. You agree not to copy, modify, reverse engineer, redistribute, or create derivative works from this Site. You may create links to this Site only through a separate browser window or tab, with the URL and the title of the Site clearly visible.

Usage of Graphs

You may use the graphs you produce using the Site as parts of instructional materials in an educational setting.

You may use graphs created using the Site in commercial products or publications if and only if you have a membership for the site that is either valid when the graphs are created, or subsequently purchased.

In no case may you redistribute image collections or other products in which the majority of the product’s value comes from the graphs themselves, whether or not for financial gain. The license to use graphs created using the Site applies only when the graphs are incorporated into instructional materials or other products which contain significant content in addition to the graphs.

Prohibited Uses

You may not use the Site in any manner that violates any applicable law or regulation, or that infringes upon the intellectual property rights of any person or entity.

You may not access the site in any way that adversely affects the operations of the Site or of its hosting provider, membership service provider, or other related entity.

You may not attempt to circumvent any security feature of the Site or its service providers, including but not limited to, those designed to provide different content or functionality to those with and without paid memberships.

Membership Credentials

If you have a paid membership, you may not share your member password or other credentials with any other person without the permission of the Site Owner.

Termination

The Site Owner reserves the the right to suspend or end the operation of the Site at his discretion and without notice. The Site Owner may terminate the right of any person to access and use the Site if, in the Site Owner’s discretion, the individual or entity has violated these Terms.

No Waiver

A failure by the Site Owner to enforce any right or provision of the Terms shall not constitute a wavier of such right or provision.

Limitation of Liability

The Site is provided “as is” and “as available,” and is not guaranteed to be free of errors or bugs. To the fullest extent permitted by law, the Site Owner disclaims all warranties of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. The Site Owner is not liable for any direct, indirect, special, or other consequential damages resulting from your use of the Site or from your inability to use the Site. You agree to defend, indemnify and hold the Site Owner harmless from any claims, losses, liability costs, and expenses arising from your use of the Site or these Terms, whether based on warranty, contract, tort, or any other legal theory.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its intent. If no such modification of that provision is possible, the provision shall be severed from these Terms. The remaining provisions of these Terms shall remain in effect.

Entire Agreement

These Terms constitute the entire agreement between you and the Site Owner and supersede any prior understandings or agreements, whether oral or written.
